MCMC and MyCC Jointly Address Exclusivity Arrangements in High-Rise Buildings

The Malaysian Communications and Multimedia Commission (MCMC) and the Malaysia Competition Commission ("MyCC") commit to working together in addressing exclusivity arrangements between telecommunications service providers and property developers or building management companies in highrise buildings including residential complexes following several complaints from the public.
MCMC and MyCC view this matter seriously as it deprives the end users of choosing their preferred telecommunications service providers, leads to high prices and poor quality for broadband services.


Thereby, MCMC and MyCC urge all telecommunications service providers, property developers and building management companies that have entered into exclusive arrangements to take immediate remedial measures, failing which, appropriate action will be taken under the provisions of the Communications and Multimedia Act (CMA) 1998 and/or the Competition Act 2010 respectively.


Recently, MCMC has published a Guideline entitled “Garis Panduan Perancangan Infrastruktur Komunikasi (GPP-I)’’ (Communication Infrastructure Planning Guidelines) to facilitate the planning and development of communications infrastructure in new property developments, which prohibits exclusive arrangements between telecommunications service providers and property developers or building management companies.
